3. Eligibility

To place an order on our Website, you must be at least 18 years of age and have the legal capacity to enter into a binding contract.

4. Ordering and Contract Formation

4.1. By placing an order, you are making an offer to purchase the selected Goods under these Terms.

4.2. A binding contract between you and us will only be formed when we have received your payment and have sent you an order confirmation email.

4.3. We reserve the right to refuse or cancel any order at our discretion, for reasons including but not limited to stock unavailability or suspicion of fraudulent activity. In such cases, any payment received will be refunded in full.

5. Pricing and Payment

5.1. All prices are displayed in South African Rand (ZAR). KifTech uses a Delivered Duty Paid (DDP) delivery process. Applicable import duties, import tax and customs fees are included in the amount shown at checkout and handled before delivery.

5.2. The total cost of your order is the price of the Goods plus any applicable shipping charge. The shipping method or courier, eligibility and fee are shown in the cart and confirmed at checkout. Standard shipping is free on qualifying South African orders of R750 or more; a R49 standard shipping fee applies to qualifying orders below R750. All charges are disclosed before purchase.

5.3. We accept payments through PayFast and supported payment methods shown at checkout, including cards, Instant EFT, digital wallets, scan-to-pay options, and selected credit/payment partners where available.

5.4. We take all reasonable measures to ensure the security of your payment information. Our website and checkout process use SSL (HTTPS) encryption to help protect your personal information.

6. Shipping and Delivery

All matters related to shipping and delivery are governed by our Shipping & Delivery Policy, which is incorporated by reference into these Terms. KifTech uses a Delivered Duty Paid (DDP) delivery process, and the shipping method or courier shown in the cart and confirmed at checkout applies to the order. Delivery delays, loss, or non-delivery are handled in accordance with our Shipping & Delivery Policy and Shipping Protection Policy.

7. Returns, Refunds, and Cancellations

All matters related to returns, refunds, cancellations and applicable statutory rights are governed by our Returns & Refunds Policy, which is incorporated by reference into these Terms. The policy explains the available processes, conditions, costs and remedies and is accessible from the website footer.

8. Product Information and Availability

8.1. We strive to describe and display our Goods accurately. Product, variant, availability, price and order information shown on the product page, in the cart and at checkout should be read together before purchase.

8.2. If a product received is faulty, damaged, incorrect or materially not as described, contact KifTech promptly. The available remedy may include a repair, replacement or refund under our Returns & Refunds Policy and applicable South African law. All orders are subject to availability.

All content on this Website, including text, graphics, logos, images, and software, is the property of KifTech (Pty) Ltd or its content suppliers and is protected by South African and international copyright laws. You may not reproduce, distribute, or otherwise use any content without our express written permission.

10. Prohibited Uses

You may not use this Website for any unlawful purpose, to infringe upon our or others' rights, to submit false or misleading information, to upload or transmit viruses or malicious code, or to interfere with the security features of the Website.

11. Limitation of Liability and Indemnity

11.1. Our total liability to you for any claim arising from or relating to these Terms is limited to the amount paid for the product, subject to applicable law.

11.2. This limitation does not affect your statutory rights under the CPA, including the 6-month implied warranty of quality as detailed in our Returns & Refunds Policy.

11.3. You agree to indemnify and hold harmless KifTech (Pty) Ltd against any claims, damages, or losses arising from your breach of these Terms or your misuse of the Website.

12. Data Protection and Privacy

We collect and process personal information as explained in our Privacy Policy, including the purposes for which information is used, the parties with whom it may be shared and the rights available under POPIA. Our Privacy Policy is incorporated by reference into these Terms and is accessible from the website footer.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Website shall be subject to the jurisdiction of the South African courts, subject to applicable consumer law.
