Intellectual Property Notice

This Intellectual Property Notice explains how KifTech (Pty) Ltd ("KifTech", "we", "us" or "our") treats intellectual property displayed on, submitted to or referenced through kiftech.co.za and our related online services. It should be read with our Terms of Service, Privacy Policy and other applicable store policies.

1. Scope of this notice

This notice applies to website text, layouts, graphics, photographs, videos, product information, software, databases, logos, trade names, reviews, customer submissions and other material made available through KifTech. It also explains our use of third-party brand names and the process for reporting a suspected infringement.

Nothing in this notice transfers ownership of any intellectual property, creates an affiliation that does not exist, or limits any right, defence, exception or remedy available under applicable law.

2. KifTech content and brand assets

Unless otherwise stated, KifTech owns or is authorised to use the original content and brand assets that we create for the website. The KifTech name, logo, visual identity, original copy, original graphics, page designs and other original materials may be protected by copyright, trade mark and common-law rights.

You may view and use the website for personal, lawful shopping and information purposes. Except where applicable law permits it or we have given prior written permission, you may not copy, reproduce, republish, modify, translate, distribute, sell, license, frame, mirror, systematically extract, scrape or commercially exploit KifTech content or use it to create a confusingly similar website, advertisement, social-media account or business identity.

No use of the website grants a licence to use the KifTech name, logo or other brand assets in a way that suggests sponsorship, endorsement, partnership, authorised-dealer status or another relationship that has not been expressly confirmed in writing.

3. Third-party trade marks and compatibility references

Third-party brand names, logos, product names, model names, trade marks and other identifiers remain the property of their respective owners. Their appearance on KifTech does not transfer any rights to us or to website users.

We may refer to a third-party brand or model to:

  • identify a genuine branded product where the listing expressly states that it is genuine or original;
  • describe the intended compatibility, fitment or replacement purpose of an independent accessory, spare part or component;
  • provide accurate technical, repair or product-selection information; or
  • compare relevant product characteristics in a lawful and non-misleading manner.

Words such as for, compatible with, replacement for, fits or similar wording identify intended use or compatibility. They do not mean that the item was manufactured, approved, sponsored or endorsed by the referenced brand owner. KifTech is an independent retailer and is not affiliated with a third-party manufacturer unless a particular listing expressly says otherwise.

An item is described as OEM, original, genuine, authorised or manufacturer-branded only where the relevant listing expressly makes that representation. Such a representation applies to that specific item and does not, by itself, mean that KifTech is an authorised dealer for the brand.

4. Product images, manuals and technical information

Some product photographs, diagrams, manuals, specifications, compatibility data and other materials may be supplied by manufacturers, distributors, suppliers or licensors. Those materials remain subject to the rights and terms of their respective owners. KifTech does not claim ownership of third-party material merely because it appears on our website.

Technical information is provided to help customers identify, compare, install or use products. It may not be copied or redistributed for a separate commercial purpose, stripped of ownership notices, or presented in a way that falsely suggests that it was created or approved by KifTech or the relevant rights holder.

5. Patents, registered designs and other rights

Products, components, packaging and technical features displayed on KifTech may be protected by patents, registered designs, copyright, trade marks or other rights owned by KifTech or third parties. Listing, selling or describing a product does not grant any licence to manufacture, reproduce, reverse engineer, copy the appearance of, or otherwise exploit protected subject matter.

6. Customer reviews and other submitted content

When you submit a review, image, video, question, answer or other content, you confirm that you own it or have the permission needed to submit it and that it does not unlawfully infringe another person's rights.

To the extent required to operate, support and promote the store and its products, you grant KifTech a non-exclusive, royalty-free licence to host, reproduce, format, adapt and display that submitted content, subject to our Terms of Service, Privacy Policy and applicable law. We may moderate, decline or remove submitted content that is unlawful, misleading, abusive, irrelevant or reasonably suspected of infringing intellectual property.

7. Prohibited intellectual-property misuse

You may not use KifTech or third-party intellectual property available through the website to:

  • create, promote or distribute counterfeit, unauthorised or deceptively branded goods;
  • impersonate KifTech, a manufacturer, a supplier or another rights holder;
  • misrepresent affiliation, sponsorship, approval, origin or compatibility;
  • remove or alter copyright, trade mark, attribution or ownership notices;
  • pass off your goods, services, website or social-media presence as connected with KifTech; or
  • interfere with, bypass or misuse measures intended to protect website content or data.

8. Reporting a suspected infringement

If you are an intellectual-property owner or are authorised to act for one, please email support@kiftech.co.za with the subject line Intellectual Property Notice. To help us assess the matter efficiently, include:

  • your full name, company name, email address and telephone number;
  • the name of the rights holder and an explanation of your authority to act;
  • the type of right concerned, the relevant country or jurisdiction, and any registration or application number where applicable;
  • a clear description of the protected work, trade mark, design, patent or other subject matter;
  • the exact KifTech URL, product listing or material you believe is affected;
  • an explanation of why you believe the use is unauthorised or infringing;
  • supporting documents, product comparisons, certificates, registrations, licences or other relevant evidence;
  • a statement that the information supplied is accurate and that you have a good-faith basis for the complaint; and
  • your typed or electronic signature and the date.

Please do not send sensitive personal information or confidential technical material unless it is reasonably necessary for the complaint. We may ask for additional information before taking action.

9. How KifTech reviews reports

After receiving a sufficiently detailed report, KifTech may review the relevant material, request further evidence, contact the supplier or contributor, temporarily restrict or remove content, correct a product description, or take another proportionate step while the matter is assessed. We may provide the substance of a complaint to the affected supplier or contributor so that they can respond.

A supplier, contributor or other affected party may submit evidence of ownership, authorisation, licence, lawful descriptive use, compatibility or another relevant basis for the material. KifTech may restore or retain content where a complaint is withdrawn, incomplete, unsupported or adequately answered.

Any voluntary action taken by KifTech is not an admission of infringement, liability or wrongdoing by KifTech, a supplier or another party. This internal review process does not replace a court process, statutory procedure or any other legal remedy available to the parties.

10. Inaccurate or abusive reports

Please ensure that a report is complete and made in good faith. We may reject reports that are materially inaccurate, misleading, repetitive, abusive, unrelated to intellectual property, or submitted without reasonable evidence of ownership or authority.

11. South African law

This notice is governed by the laws of the Republic of South Africa. Relevant rights may arise under, among other laws, the Trade Marks Act 194 of 1993, Copyright Act 98 of 1978, Patents Act 57 of 1978, Designs Act 195 of 1993 and applicable common law. The availability and scope of any right, exception, defence or remedy depends on the facts and the applicable law.

We may update this notice to reflect changes in our products, content, processes or legal obligations. The date at the top shows the latest revision.
